WAU’s panel on Controversial Investment Awards Against States in South Asia will provide an insight on those adverse awards that have involved claims of corruption, conflicts of interest or ungrounded novel damages calculations. Particularly, the panelists will examine: The most recent controversial awards issued against South Asian States and the criticisms of those awards. The growing movement in South Asia to reform the ISDS system as a response to the criticisms of the controversial awards. Examples of various provisions adopted to reform the existing ISDS framework, such as India’s new model BIT, and The positions of Bangladesh, India, Pakistan, and Sri Lanka through their active participation in the Working Group III of UNCITRAL.
